Right to do a Ph.D?

There was a recent story in the Indian Express about a magistrate moving the Delhi High Court after Delhi University refused to enroll her for a Ph.D. The story is here:

The University refused to let Metropolitan Magistrate Twinkle Wadhwa pursue her Ph.D unless she took study leave. Her petition has dubbed the condition as a choice between ‘right of livelihood vs. right of education’.

The Constitution and the RTE Act make elementary education a fundamental right. There is no law which guarantees the right to do a Ph.D. Therefore there is no question of anyone in India being deprived of their right to education in such circumstances.
